California's Overtime Laws:
In California, most employees who are 18 years old or 16 and 17 years old who have the legal authority to leave school to work, including certain salaried employees, are entitled to overtime compensation.
So, in order to answer this issue more precisely, analyze who in is not qualified for overtime compensation.
The following personnel does not have an entitlement to enhanced overtime pay:
- Unionized employees
- Outside salesperson
- Workers in specific occupations
- Agricultural workers
- Independent contractors
- Alternative workweek schedules
- Commission-based pay
What are Overtime Compensation Laws?
Employees who work in their “spare time” are eligible to overtime pay. It’s also a way to make sure that companies don’t force workers to work too many hours and don’t hire new workers who may be entitled to benefits even though they’re paid the same.
The California Employment Code 510 has rules about overtime. Under the law, a day’s work is described as eight hours of work. The next part says:
Any extra work done beyond eight hours in a single workday or 40 hours in a single workweek, as well as the first eight hours of work on the seventh day of work and the first eight hours of work in any given workweek, will be paid for at 1.5 times the regular rate of pay.
If a worker puts in more than 12 hours of work in a single day, the boss has to pay him or her twice the normal rate of pay.
